What documents are needed for a divorce through court

If a husband and wife are ready to divorce, and at the same time they have joint children under the age of eighteen, then they will have to go to court. In this case, the following package of documents is submitted to the judicial institution:

  • a general application for divorce to be completed by both parties;
  • copies of passports;
  • a copy of the marriage certificate;
  • a copy of the birth certificate of children;
  • a check from the bank confirming the payment of the court fee.

In this case, the court will require the parents to agree on the upbringing and provision of the child after the parents divorce. In this document, the responsibility for the children is divided between the father and the mother. The document defines:

  • material responsibility;
  • where the children will live;
  • schedule of communication with parents;
  • other conditions.

If the divorce occurs on the initiative of only one of the spouses, then the same documents, only instead of a joint application for divorce, it will be necessary to prepare a statement of claim for divorce. In this case, the papers are submitted to the department of the court located at the place of residence of the defendant.

In the claim, it is imperative to mark the place of registration of the defendant, since a notice of the upcoming hearing will be sent to him. If the second party does not appear at the meeting and there is no document confirming its notification, the trial may be postponed.

After the end of the trial, the former spouses receive a decision to dissolve the marriage, which is a confirmation of the legality of the divorce. In addition, the couple will need to look at the registry office in order to put a divorce stamp in their passport.
