Deprivation of parental rights is a legal procedure aimed at establishing the rights of biological parents or guardians in relation to a child. As a result of the deprivation of parental rights, the person deprived of the rights loses the rights provided for by family law in relation to the child and make decisions about his upbringing and determining the future.
One of the most important elements of marriage is the establishment of parental rights. Parental rights are personal non-property rights of individuals in relation to children who were born during marriage or adopted. Driving license regulates both personal non-property rights and property rights of individuals related to the redistribution of inheritance and issues related to guardianship and similar issues arising in everyday life.
The procedure for deprivation of rights takes place with the help of a court or in a pre-trial procedure by decision of the body providing supervision of the welfare of children (guardianship authority). The decision of the child custody authority can be appealed in court if it is made in violation of family law and is not motivated by real circumstances.
The court can apply directly to parents who wish to take away parental rights or interested parties provided for by the family code. To do this, you need to prepare an appropriate claim for deprivation of parental rights and file it in a civil court within the jurisdiction of which the case is being considered. As part of the proceedings in the case of deprivation of parental rights, the local child custody authority is involved, which submits its conclusions on the advisability of depriving parental rights.
