Disputing paternity is a legal procedure aimed at establishing the fact or not of the fact of kinship between the alleged father and his child. Such a procedure involves the establishment of legal obligations prescribed by law in relation to the father’s duties to provide for the child, or in relation to his right to have parental rights in relation to the child and decide his fate.
Kinship is a special type of legal relationship arising from individuals in the process of marriage. Kinship defines the relationship between family members, as well as their rights and obligations. These relations are regulated by the family legislation of Ukraine, which describes all types of kinship and relations between relatives. Within the framework of family relations, various issues arise, including the rights that relate to property and non-property rights of family members, as well as the ability to dispose of such rights
Paternity is challenged by filing a statement of claim with a court in the relevant territorial jurisdiction of the case. The applicant can be either a mother or a father who does not want to recognize the child. Establishing the fact of paternity allows you to resolve the dispute between parents in relation to the rights and obligations in relation to the child. Having considered the case, the court makes a decision on recognizing the child as the father or refusing to recognize the child as the father.
Cases of recognition as a father may be accompanied by accompanying claims for the recovery of alimony and costs associated with the inaction of the parties in relation to the child.
